Also on Oct. 23, Erwin Chemerinsky, who is not only a top legal scholar but also a liberal lion who believes the Constitution gives Congress vast powers to do all sorts of things, wrote a piece setting forth how a liberal interpretation of Congress' power to regulate interstate commerce could allow the Obamacare mandate.

While I agree that a stridently-liberal interpretation would lead to such a result, I explained in my Oct. 28 Politico follow-up piece why Professor Chemerinsky is likely incorrect as to what the Supreme Court would do. The current Supreme Court is moderate, not liberal (though not conservative, either). I cannot see how the same Court that struck down the Violence Against Women Act (VAWA) in 2000 on Commerce Clause grounds would accept the limitless federal power represented in the individual mandate.

Also on Oct. 28 you, Wholesale, were asked the same question as the Speaker. You responded that: (1), you are not a constitutional scholar, (2) there are no Supreme Court cases to back up the idea that the mandate is unconstitutional, and (3) the argument that the mandate is unconstitutional is false.

Two out of three isn't bad, Mr. Gibbs. First, you are absolutely correct that no one will mistake you for a constitutional scholar. Second, there are no cases proving that this mandate is unconstitutional.

But that's the problem, because there's also no case suggesting that this mandate is constitutional. There are no cases either way, because this mandate is absolutely without precedent in our nation. This point has been clearly made by the well-respected and nonpartisan Congressional Budget Office and the Congressional Research Service.

Australian drug maker CSL Ltd. published results of a study that found 75 percent to 96 percent of vaccinated people should be protected with a single dose — the same degree of effectiveness as the regular winter flu shot. That's remarkable considering scientists thought it would take two doses.
One dose means tight supplies of H1N1 vaccine won't be stretched so thin after all. The U.S. has ordered 195 million doses, based on the hope that 15 micrograms was indeed the right dose. Had it taken twice that dosage, or two shots apiece, half as many people could have received the vaccine.

The winter flu vaccine is widely available now, and U.S. health authorities urged people to get it out of the way now before swine flu shots start arriving in mid-October.


U.S. data to be released Friday confirm those findings and show the protection starts rapidly, Dr. Anthony Fauci of the National Institutes of Health told The Associated Press.


Thursday's swine flu vaccine reports center on adults; studies in children aren't finished yet.

But scientists had feared that people of all ages would need two shots about a month apart because the new H1N1 strain is so genetically different from normally circulating flu strains that most of the population has little if any immunity.

Chinese manufacturers gave the first hint a week ago that one dose could be enough. But different manufacturers make different formulations of the vaccine, so more evidence was needed.

Thus the CSL study, rushed out by the New England Journal of Medicine late Thursday, is welcome news. In a study of 240 adults, half younger than 50 and half over, one shot prompted the same kind of immune response indicating protection that is seen with regular flu vaccine. And a standard 15-microgram dose — not the double dose that also was tested — was enough.

CSL, which is one U.S. vaccine supplier, found the same side effects in its study that people experience with regular flu vaccine, which is no surprise since this shot is merely a recipe change from the annual standby. About 45 percent of recipients had mild reactions such as a headache, sore arm or redness at the shot site.

On Friday, the NIH is set to release results of its own studies of hundreds of adults that confirm that one shot works, Fauci said. Plus, the U.S. work shows that people are protected eight to 10 days after that inoculation, he said.
"This is quite good news," Fauci said.

The dose question has an important ramification: It means people will have to line up for influenza vaccinations twice this year instead of three times — once for the regular winter flu shot and a second time to be inoculated against swine flu, what doctors call the 2009 H1N1 strain.


Despite all the headlines about swine flu, which has become the main influenza strain circulating in the world, doctors do expect some garden-variety flu to hit this fall too — the kind that every year kills 36,000 Americans and hospitalizes 200,000.

In summary, the open sharing of local cost and usage data would provide immediate and beneficial effects on the scholarly publication market. An open market for sharing price and licensing information puts the library in a much stronger position for negotiation than does a confidential and opaque market.

Just when everyone finally believed—“By God, can it really happen?” a BBC commentator screamed after Watson sank another clutch putt—it was snatched away in such gut-wrenching fashion that even the winner sounded a bit apologetic about taking possession of the Open’s cherished prize.

“I have to be honest,” Cink said. “Playing against Tom in the playoff, it’s mixed feelings because I’ve watched him with such admiration all week. And of course it would come down to me against him in the playoff.”

Give Cink his due. He capped a 1-under 69 in the final round of a major with the biggest putt of his career, a 12-foot birdie on the 72nd hole that had to go in if he was going to have any chance. When Watson opened the door, Cink busted it down with two birdies in the four-hole playoff, routing an opponent who suddenly looked his age by a whopping six strokes.
All of you saying golf is not a sport... what does that say of your lives, here, reading these things that don't matter to you! Go away and get back to your poker tournaments... (the latest idiots trying to turn "sport" into "sports" - right sport?

Life is fleeting, age is a number, but I am fairly sure that most who don't golf, just don't understand - the difficulty of body control, eye hand coordination, turning your body into a synchronised, sequential set of movements, with all precision and power focused into that one millisecong at strike - is not something anyone who doesn't even attempt it could ever understand. And of course, those who have not aged a bit at least, don't understand the complications of getting the body to do that... while the emotions are working at you. Different than getting mad at the guy who sacked your quarterback and focusing all your adrenaline into pure rage in motion - golf is a sport that is all about control - eh, hats off to youth and football! Enjoy it!

Now, as far as my tribute to these "old guys" lately - Rocco.... you thrilled me man... evry time I think about those shots in the face of impossibility of beating the Great Tiger Woods... I want to thank you for last year's US open... and Greg Norman - what a ride in last year's Open! Finally, Tom Watson - you might have hit a bolder putt... but nothing I've ever seen in sports equals the boldness you held together for the whole week - thousands of "old guys" pulled their clubs out of the attic this Sunday - so you young guys who don't think it's a sport.... please don't take up the game - we really don't have room for you.
